The following is provided as an update with regards to the 8th tee works undertaken by the Club and subsequent appeal with the Land & Environment Court against a received notice to remove the works.
In 2021 the Club undertook remedial repairs to the 8th tee as a measure to protect against erosion of the surrounding banks.
These works included the construction of a sandstone retaining wall to the northwestern edge of the rear tee and to the south eastern frontage of the forward tee. During the works the Club also completed landscaping works within the riparian zones to address noxious weed removal.
During construction the team undertaking the works were visited by a representative from Council with regards to sediment control measures in place. These were deemed adequate at the time with an additional settlement control fence installed. The visit from a Council representative during the work gave the Club confidence that the works were reasonable to continue.
The works were completed. In 2022, the Club were advised a complaint had been lodged to Council about the works. The club proceeded to retrospectively apply for BIC to approve the works.
The BIC application was rejected and was followed by a Works Order Notice to remove the erosion protection measure and return the site to former condition. The Club commenced an appeal against the order.
On Friday 17th of March 2023 a Land & Environment conciliation was conducted on the site with parties (Council & Club) then reconvening for discussion to reach an in principle agreement. These discussions progressed, though not completely resolved and the conciliation will reconvene on Thursday 6th April.
The Club will be preparing a modification plan to the works and other agreed terms prior to the follow up and remain confident of reaching an agreement that doesn’t require progressing either to a full hearing of the Land & Environment Court or complete demolition of the works.
The Club in lodging its appeal received supportive expert advice and will seek additional prior to the follow up to address any remaining items of concern.
